Even the wife has no right to know everything


Bengaluru. A division bench of the Karnataka High Court has said that marriage does not take away the procedural rights of a person with respect to disclosure of his personal information.

Setting aside the single judge order, a division bench of Justices Sunil Dutt Yadav and Vijaykumar A Patil said the procedure under Section 33 of the Aadhaar Act must be followed even if the person seeking the information is the wife. According to Section 33 (1), no court inferior to a High Court judge has been given the power to pass an order to disclose information. But the high court said the single judge's order had directed the authority below him to provide the details.

The learned Single Judge has committed complete error in directing the Assistant Director General, Central Public Information Officer to issue notice to the person in respect of whom information has been sought, the Division Bench said. The woman, resident of Hubli in North Karnataka, had sought information about her husband's address mentioned in his Aadhar card from the Public Information Officer.
